This may be true, yet the Internet is also one of the music industries greatest enemies. For some years now online shopping has been available to anyone with a credit card and an Internet connection. E-commerce retailers such as Amazon.com sell everything from garden tools, to C.D’s and mini-discs. It is only in the last couple years however, that online shopping has taken off. Before this the public and businesses alike had not been taking full advantage of this phenomenal asset, which has been proven to save companies millions. It was only with the creation of Windows 98 and other Internet programs that people were sure that their credit card numbers and personal details could not be viewed by another person, or ‘hacked’. Once this huge hurdle was overcome, the way we used the Internet and the effect it had on the music industry had changed forever. The close relationship between the Internet and the music industry has led to many dramatic revolutions. First of all it has changed the way in which we purchase music. You might say that it was Napster that revolutionised the way we obtain music from the Internet, not the new technology. There was however, one fatal flaw with this website. All the music that was being ‘shared’, had copyright to its name, and Napster was using these songs without paying the record companies. So on December 7, 1999, The Recording Industry Association of America sued Napster for copyright infringement. They were asking for damages of $100,000 each time a song was copied. This however did not stop Napster operating as normal, it was only when they were sued by the hugely popular rock band Metallica that Napster was prompted to take action, or at least look like they were taking action. There are four key conditions that have been identified as influencing the need for change to law. Changing social values led to same-sex couples being recognised as de facto relationships. This led to the Property (Relationships) Act 1984 (NSW). Another important condition that gives rise to law reform relates to new concepts of justice. As social values change, so does the idea of justice. It is therefore seen that the domestic legal system if effective in keeping up with technological advancements. However, technology continues to advance and in order for the law to remain effective it needs to keep up with these changes. A fourth condition that gives rise to law reform is the failure of existing laws. If a law is not being effective, there is a need for law reform. In order for there to be a law reform, a current law must be broken. An example of law reform is this area is seen in the case of AVO’s. The two agencies that are most influential in carrying out law reform are the parliament and the courts. In relation to the parliament, statute law refers to laws passed in parliament. It allows them to make court orders regarding the members that associate together. The courts are another important agency of law in Australia. Common law refers to laws passed by courts. The doctrine of precedent is utilised whereby judges must resolve disputes on the basis of decisions made in similar cases. This alone deems the law effective in providing equality to society. One recent example of common law in action relates to Christian Rossiter, a man with spastic quadriplegia after being hit by a car. He argued with the Supreme Court to allow him to refuse the food he is fed by his carer. In doing this, he agreed to understand the consequences of dying, but to Christian dying was better than staying alive in pain. The law reform commission (LRC) in both NSW and Australia plays an important role. The role of the LRC is to provide and improve access to justice, modernise and simplify the law, eliminate problems in the law, suggest new ways of administrating the law and providing justice and removing out dated and unnecessary laws. At the present time, the LRC is involved in many current projects which are helping in changing the law for the better. It is currently working on areas in bail, penalty notice offences, jury directions in criminal trials and people with cognitive and health problems in the criminal justice system. A case that determines a mechanism of law reform relates to Skye’s Law in NSW. This this case the existing law appeared to be failing. In December 2009 a 19-month-old baby, Skye Sassine was killed in a road rage accident. Police were on a high speed chase after two alleged robbers in Sydney’s southwest. The law which was put in place by the NSW cabinet stated that anyone who leads a high speed chase will face jail terms of up to five years. Therefore it can be seen that both statute law and common law have been effective in allowing the legal system to respond to the need for law to make the legal system function in a more effective manner. (Blaut pg. 6-7). African-American people have had to climb over many obstacles to get to their position today. First, was the selling of their people into slavery. Then, they endured slavery itself, being treated like an animal. After slavery was abolished, Colored people still had to deal with racial discrimination and hatred. If this sounds rough, black women had it worse. African-American women had to deal with all the previously mentioned things, but they were women to o! Females were oppressed almost as bad as the blacks. White women were not able to vote until the 1920. Therefore colored women had a double edged sword, they had to fight for freedom, but not be to dominate as to effect the men. Alice Walker's The Color Purple is a good example of colored women's plight. Three obstacles black women had to overcome to be able to express themselves were Racism, the lack of education, and the stereo-type that women are inferior. African-Americans have always experienced racism throughout their habitation in America. Slavery, is what caused most of the hatred towards blacks. African Americans were sold by their people and sent off to a foreign land. Colored people were used as work horses when they entered America. "It was acceptable for a white person to be lazy (in the South), and therefore, a white person takes advantage of this" (Theriault). White people wanted to keep their laziness. If the slaves were set free, then the whites would have to do more work. The slaves still fought for what they wanted, and finally won their "independence." Another dilemma was "if the south could abolish slavery, what would happen to the slaves? These slaves have been slaves for all their lives and would require education. These slaves would also require homes, some type of compensation, and more" (Theriault). Blacks were put in prison for rebelling against the white establishment. Most times these crimes were minuscule in comparison to the crimes committed against blacks or by whites. A colored person could be put in jail for looking at someone inappropriately, but if a black man was lynched, nothing happened. "I have been locked by the lawless. Handcuffed by the haters. Gagged by the greedy. And, if I know any thing at all, it's that a wall is just a wall and nothing more at all. It can be broken down" (Shakuer). This excerpt from "Affirmation" is an example of the feelings of hatred for the Whites. However, this quotation also shows the fight in the African-American race let alone its women. If the South could have kept education away from the blacks. Then ides as the one above would have never been published. Lack of education was a way the South tried to keep the blacks in a lower class. In The Color Purple, Celie is not allowed to go to school because she is to be kept barefoot and pregnant. She still received an education by learning what her little sister was teaching her, though. It was believed that if the blacks were kept uneducated then they would not know any better and would not fight for freedom. Unfortunately, for the South, the North was educating their blacks.
